FAIR USE IS PERMITTED

i) Images may be used for personal, commentary, parody, news reporting, research, education or non-commercial purposes and the artist (Adam Gillespie) along with the gallery (Beat Kids Gallery) must be credited.

ii) You may not alter, transform or build upon this work in any form.

UNAUTHORISED COMMERCIAL USE IS PROHIBITED INDEFINITELY

No images off of the Beat Kids Gallery may be used for commercial purposes including albums, posters, advertisements, etc.

Those who infringe on copyright will be discovered and appropriate consequences will follow.
 
SERVICES
The Beat Kids Gallery has the right to refuse service to anyone for any reason not prohibited by law.
 
RECORDS
Any e-mail recieved by the Beat Kids Gallery that is unlawful will be recorded and proper authorities will be notified.
This includes but is not limited to e-mails that contain threats of bodily harm and attempted scams.
Emails registered with the gallery will be kept private and confidential.
 

Commissions:

Commissions are usually accepted or declined by Adam Gillespie within 1-5 business days. All serious requests will be considered.

Nearly all works completed by Adam Gillespie are in physical form. A physical piece of artwork may be created for the purpose of a commission, the client may either use the digital image of the physical work OR obtain the physical work which will cause the price of the commission to increase.

Once the commission is accepted a rough sketch with be completed and digitally transferred to the client for approval or denial. If the design is denied, the artist will work accordingly with the client until the design is approved. Design changes after the original sketch is approved is not permitted.

Once the design is approved by the client a 50% down payment will be required (through PayPal).

Throughout the production of the artwork, the client will be contacted and supplied with low-resolution images of the artwork being produced.

Once the work is completed the client will be contacted again and supplied with low-resolution photographs. Once the complete payment is recieved the client will then obtain either the high-resolution image or the physical artwork.

Terms and Conditions:

GENERAL 

Prices quoted may be subject to change due to unforseen circumstances.

By obtaining and agreeing to use the services of the artist, the client agrees that he/she has read and understood the TERMS AND CONDITIONS, LEGAL & COMMISSION information page.

All agreements must be kept confidential between the client and the artist.

PROPERTY RIGHTS

Unless otherwise written and agreed to, the copyright of all artwork remains with the artist indefinately.

Unless otherwise written and agreed to, the artwork (designs, drawings, sketches, drafts, final and completed work) remains the property of the artist.

USE & LICENCE

Once the commissioned artwork is completed, the client will be permitted to use the design only under conditions agreed to between the client and the artist that will be stated in a licensing contract by the CARCC.

The artist obtains the right to use the commissioned design at his own discretion such as publicity, promotional or commercial purposes with respect to the clients interest.

TERMINIATION

If the client for whatever reason terminates the agreement, he/she will not recieve the down payment, it will remain with the artist.

If the contractor terminates the agreement due to breach by the client in regards to the performance of the agreement set forth, the client will not recieve the down payment, it will remain with the artist. 

LIMITATIONS OF LICENSE

Unless otherwise written and agreed to, the artwork supplied to the client remains the copyright and property of the artist, Adam Gillespie and has the power of disposition of the work. 

PAYMENT

Upon completion of the artwork, the client will have 30 days to supply to final payment. If the client does not supply the payment within 30 days it will be considered a breach of agreement between the client and the artist resulting in the forfeit of payments and ability to obtain the artwork.

Only under extreme or unforseen circumstances will the artist waive any fees owed or supplied by the client.

LIABILITY

The artist Adam Gillespie will not be held liable under any of the following circumstances...

i) Misunderstandings, errors or defects in the performance of the agreement caused by the client.

ii) Errors or defects in the design that the client has previously approved.

iii) Lost or damaged artwork through the transportation of mail.

ORIGINALS 

The Beat Kids Gallery hosts, promotes and sells original artwork by Adam Gillespie.

All original artwork is hand packaged and comes with a certificate of authenticity.

Complete payments must be recieved  before the shipment of the work.

HOW TO OBTAIN A LICENSE

All artworks are protected under international copyright laws, if you wish to obtain a commercial licensing agreement for reproduction, contact the CARCC about licensing artwork from Adam Gillespie.
